Terms of Service

Please read these Terms of Service ("Terms") carefully before using the ClaimCheck mobile application ("the App") operated by Prismind Analytics LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through the App. Your continued use of the App after changes constitutes acceptance of the revised Terms.

2. Description of Service

ClaimCheck is a mobile application that helps users identify potential errors and discrepancies in medical bills by comparing them with Explanations of Benefits (EOBs). The App provides on-device document scanning, optical character recognition, automated billing analysis, and dispute letter generation.

All document processing occurs entirely on your device. We do not receive, store, or process your medical documents or personal health information.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this eligibility requirement.

4. Not Medical, Legal, or Financial Advice

The App is designed to assist you in reviewing medical bills and identifying potential errors. However:

• The App does not provide medical advice or diagnoses.
• The App does not provide legal advice. Dispute letters generated by the App are templates that may need to be reviewed or modified for your specific circumstances.
• The App does not provide financial or insurance advice.
• The App does not guarantee the accuracy of its analysis. OCR and automated analysis may produce errors, particularly with poor-quality images, unusual document formats, or complex billing scenarios.
• The App does not guarantee that identified discrepancies constitute actual billing errors. Medical billing is complex, and there may be legitimate reasons for apparent discrepancies.

You should always verify the App's findings independently and consult with your healthcare provider, insurance company, or a medical billing advocate before taking action based on the App's analysis.

5. User Responsibilities

When using the App, you agree to:

• Use the App only for its intended purpose of reviewing your own medical bills (or those of family members you are authorized to manage).
• Provide accurate documents for analysis. The quality of the App's analysis depends on the quality of the scanned or imported documents.
• Not use the App for any illegal or unauthorized purpose.
• Not attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Not use the App to commit fraud, submit false claims, or engage in any deceptive practices.
• Take responsibility for any actions you take based on the App's analysis, including filing disputes or making payments.

6. Subscriptions and Payments

6.1 Free Tier

ClaimCheck offers a free tier that includes up to 3 bill reviews per month with core error detection features. No payment information is required to use the free tier.

6.2 Paid Subscriptions

ClaimCheck offers the following optional paid subscriptions:

• Pro ($4.99/month): Unlimited bill reviews, dispute letter generation, spending trends, PDF export, and smart reminders for one user.
• Family ($7.99/month): All Pro features for up to 6 family members with individual profiles and deductible tracking.

6.3 Payment Processing

All subscriptions are processed through Apple's App Store. By subscribing, you also agree to Apple's terms and conditions for in-app purchases. We do not receive or store any payment information.

6.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple ID settings.

6.5 Refunds

Refund requests for subscriptions must be directed to Apple, as all payment processing is handled through the App Store. We do not have the ability to process refunds directly.

7. Intellectual Property

The App, including its design, features, code, content, algorithms, and rule engine, is owned by Prismind Analytics LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

• Modify, adapt, or create derivative works based on the App.
• Distribute, sublicense, lease, rent, or lend the App.
• Use the App for any commercial purpose without our prior written consent.
• Remove, alter, or obscure any proprietary notices in the App.

8. Accuracy and Limitations

While we strive to provide accurate billing analysis, you acknowledge and agree that:

• The App's analysis is based on automated pattern matching and rule-based detection, which may not catch all errors or may flag items that are not actually errors.
• OCR technology may misread text, particularly from low-quality scans, handwritten notes, or unusual document formats.
• Medical billing rules and regulations vary by state, insurance plan, and provider, and the App may not account for all variations.
• Reference data used for error detection (such as Medicare fee schedules and coding standards) may not be current or applicable to your specific situation.
• The App is not a substitute for professional medical billing review.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL PRISMIND ANALYTICS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Prismind Analytics LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, violation of these Terms, or any action taken based on the App's analysis.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

11.2 Arbitration

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in King County, Washington. You agree that any arbitration shall be conducted on an individual basis and not as a class action or representative proceeding.

11.3 Exceptions

Notwithstanding the arbitration provision, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

You may terminate your use of the App at any time by deleting it from your device. All locally stored data will be permanently deleted when you remove the App.

13. App Store Terms

You acknowledge that these Terms are between you and Prismind Analytics LLC, not with Apple Inc. Apple is not responsible for the App or its content. To the extent these Terms conflict with Apple's App Store Terms of Service, Apple's terms will prevail with respect to the use of the App Store.

Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no warranty obligation with respect to the App.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prismind Analytics LLC regarding your use of the App, and supersede any prior agreements or understandings.
